GPS Surveyor – Terms of Service
These terms apply to your use of the GPS Surveyor app ("the app"), provided by its developer, markogola ("we", "us"). By installing or using the app you agree to them. If you do not agree, do not use the app.
1. Licence
We grant you a personal, non-exclusive, non-transferable licence to use the app on Android devices you own or control, in line with these terms and the Google Play Terms of Service. You may not copy, modify, reverse engineer, resell or redistribute the app except where the law allows this despite this restriction.
2. Accuracy of positions – important
- Positions, distances, areas, altitudes and accuracy figures come from your device's GPS and location services. They can be wrong because of the device, the satellite signal, buildings, trees, weather or other conditions.
- Accuracy estimates (for example "±5 m") are statistical estimates, not guarantees.
- The app is not a certified survey instrument. Its results are not a substitute for a licensed land surveyor and must not be relied on as the sole basis for land boundaries, title, legal disputes, engineering set-out or construction where precision is required.
- Do not rely on the app for safety-critical navigation, including emergency, aviation, marine or mountain-rescue use.
You are responsible for checking results against suitable methods before relying on them.
3. Your data
Waypoints, routes and settings are stored on your device, and you are responsible for keeping copies of anything you need. Uninstalling the app or clearing its storage deletes this data. How we handle information is described in our Privacy Policy.
4. Purchases
The app is free to download. If optional paid features are offered, they are sold through Google Play, and Google Play's terms and refund policies apply to those purchases. Paid features may be added, changed or withdrawn in future versions; anything you have already bought will continue to work in the version you bought it for.
5. Maps and third-party services
Maps are provided by third parties: map data © OpenStreetMap contributors (ODbL) and topographic maps © OpenTopoMap (CC-BY-SA). Map tiles may be unavailable, out of date or inaccurate, and their providers' terms apply. Location services on your device may be provided by Google under Google's terms.
6. Acceptable use
Do not use the app to break the law, to track another person without their consent, or to interfere with the app or the map services it uses.
7. No warranty
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose or uninterrupted operation, to the extent permitted by law.
8. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss of data, profit or business, arising from your use of the app or reliance on its results. Our total liability for any claim is limited to the amount you paid for the app or its paid features in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.
9. Changes and termination
We may update the app and these terms. The current terms are always published at this address with their effective date; continuing to use the app after a change means you accept the updated terms. You may stop using the app at any time by uninstalling it.
10. Governing law
These terms are governed by the laws of Kenya, without prejudice to any mandatory consumer protection laws of the country where you live.
